Judge Rejects Request to Stop Evictions

A Utah judge has rejected a request to stop preparations to evict hundreds of residents from two polygamous communities on the Utah-Arizona border.
Judge Denise Lindberg said in a Tuesday ruling there were several unresolved issues with facts and procedures in the motion by lawyers for the residents in the border communities of Hildale, Utah, and Colorado City, Ariz., the Salt Lake Tribune reported Wednesday.
People threatened with eviction either formerly or currently belong to the Fundamentalist Church of Jesus Christ of Latter Day Saints, the newspaper said.
The judge said the 5th District Court will handle eviction proceedings instead of her. She added that lawyers failed to give sufficient notice of the motion and did not file a bond needed for restraining orders.
The good news to our clients is that there is not eminent danger of them being removed without further litigation in the 5th District Court, attorney Bret Rawson said.
